Terms & Privacy

 

Billing
(a) Customer guarantees the payment of all charges incurred by the Customer(s) for service provided by MobileTel Internet in accordance with the terms and conditions contained in the applicable tariffs on file with FCC or where appropriate, the regulatory agency having jurisdiction.
(b) In the case of errors or questions about a bill, the Customer is to refer inquiries to our MobileTel Internet Offices at PO Box 1416, Larose, LA 70373
Illegal Usage
(a) MobileTel Internet services will only be used for lawful purposes.
(b) Use of a MobileTel Internet account(s) for Illegal activities, to gain passwords, security codes or encryption keys of MobileTel Internet or MobileTel Internet Users or other sites or computer networks are grounds for immediate termination and, if illegal, will be reported to the proper authorities.
Electronic Mail
(a) MobileTel Internet does not monitor in any way, the content of a customer's e-mail, newsgroup postings, downloads, etc., the Customer understands that MobileTel Internet has the right to monitor user activity if said activity is has having an effect on the services and /or another site. MobileTel Internet will not disclose user activity to another site or entity unless required by court subpoena, court order, or other legal force.
(b) MobileTel Internet reserves the right to move, delete, or minimize the Customers mailbox if said mailbox has reached a size that adversely affects system performance. Any mail processes being run can be terminated by MobileTel Internet if adversely effecting system performance. In the instances where system performance is being adversely affected MobileTel Internet is the sole judge of what defines "adverse to system performance".
Netiquette

We ask you to be civil and to show respect for others. Don’t interfere with another Customer’s enjoyment and use of the Internet. Accordingly, MobileTel Internet reserves the right to give you a warning or, at our discretion, terminate your membership.
The Customer agree to abide by the generally accepted rules of Netiquette and the accepted policies of any networks or services accessed while using MobileTel Internet. It is the customers responsibility to familiarize himself/herself with these rules if he or she does not already understand these rules. Any violation of these rules and policies can be grounds for termination of a customers account with MobileTel Internet.
If you receive a warning - A warning indicates that your language or conduct does not comply with these Terms of Service. Please, take the time to read these Terms of Service again. They are posted in the
MobileTel Services. With the exercise of some plain common sense, they’re easy to comply with. Let’s look at some examples of prohibited conduct:
Violation of Netiquette that can result in the termination of a customers account include, but are not limited to, the following:

(a) Advertising, Solicitation and Name Harvesting. Unless you obtain express permission from the Customer in advance, you may not use MobileTel Internet to send unsolicited advertising, promotional material or other forms of solicitation to another Customer except in areas designated for such a purpose (e.g., the classified area). You may not use MobileTel Internet to collect or "harvest" screen names of other Customers without the express prior permission of the Customer. MobileTel Internet, Inc. reserves the right to block or filter mass e-mail solicitations on or through MobileTel Internet.
(b) Spamming or Mail Bombing This refers to the sending or very large and/or very many messages to a user or site as to cause that users or sites mail server to crash or to cause their mail to bounce.
(c) Unsolicited E-Mail Sending unsolicited E-mail which provokes complaints from the recipient(s).
(d) Chain Letters and Pyramid Schemes. Certain chain letters and pyramid schemes are illegal. Transmission of chain letters and pyramid schemes of any kind is not allowed on MobileTel Internet. This material places an unnecessary load on our e-mail system and is considered a nuisance by many Customers. Not only are chain letters (or messages that offer a product or service based on the structure of a chain letter) of questionable legality, they are a waste of resources and MobileTel Internet does not permit them.
(e) Graphic Files. MobileTel Internet, Inc. prohibits the transfer or posting on MobileTel Internet, or pointing to or referencing, sexually explicit images or other Content it deems offensive.
(f) Impersonation. This can involve the portrayal of another person or entity, such as the impersonation of MobileTel Internet, Inc. staff or an independent content provider ("ICP"), authorized Guide or Host, or communication under a false name or a name that you are not authorized to use, such as a celebrity. Customers may not pretend to be MobileTel Internet, Inc. personnel or other persons in any online communication, for example by using screen names, Customer profiles, chat dialogue and message postings.
(g) Password Solicitation. Its absolutely prohibited to solicit or attempt to obtain a Customer’s password, account or financial information. The best protection against someone improperly obtaining your password, account or financial information is to NEVER give out your password. "Loose lips sink ships!" Remember, MobileTel Internet employees or representatives will NEVER ask you for your password online. So if someone asks you for it, refuse and report the incident to MobileTel Internet Customer Services immediately.
(h) Offensive Communication. Using vulgar, abusive or hateful language is not allowed (even when masked by symbols). Please use your best judgment and be respectful of other Customers. Remember, children may be online.
(i) Harassment. When a Customer targets another to cause distress, embarrassment, unwanted attention or other discomfort, this is harassment. We don’t allow harassment and may suspend or terminate a Customer who harasses others. Prohibited are attacks based on a person’s race, national origin, ethnicity, religion, gender, sexual orientation, disability or other identification. If you have a disagreement with someone, don’t make it personal on MobileTel Internet.
(j) Illegal Storage Using the MobileTel Internet servers for exchange or storage of illegal or pirated software.
(k) Illegal Instruction Using a MobileTel Internet server(s) to provide instructions about hacking into computer systems or creation of viruses.

Security
(a) Information transmitted over the Internet and/or other computer networks is generally not considered to be secure. MobileTel Internet respects the privacy of our customers. Customers understands that there is no guarantee of privacy on the Internet and that MobileTel Internet cannot be liable or responsible for any viewing or interception of Customer’s e-mail, downloads, news, etc. by other customers or individuals at MobileTel Internet or on any network.
Service Quality
(a) MobileTel Internet makes no warranty of its service and availability. While a good faith effort will be made to minimize any and all downtime to scheduled maintenance periods, no guarantees are made as to any account, product, or service offered by MobileTel Internet. In addition MobileTel Internet makes no warranty of customer transmissions, connections, downloads, etc. Customer is solely responsible for any losses, damages, or expenses related to service failure, whether caused by MobileTel Internet or a customer, and agrees that MobileTel Internet shall not be liable for any or of the same.
(b) Customer agrees to indemnify and hold MobileTel Internet wholly harmless from and against any and all liabilities that may arise as a result of the failure of services equipment or software of MobileTel Internet, with the exception of willful misconduct or omission of MobileTel Internet.
Termination of Service

(a) MobileTel Internet reserves the right to terminate all services to any customer with multiple accounts should any such account become delinquent and are not paid within 60 days of any billing due date. Multiple accounts include but are not limited to parent, subsidiary, and affiliated corporations; individuals and partnerships; individuals and sole proprietorships; and any other entities to which there is any direct or indirect connection between the accounts.
(b) Customer understands that MobileTel Internet reserves the right to terminate any account for any reason and at any time. Customer’s sole remedy is to receive a refund for prepaid but unused service.

Cancellation of Service
(a) Customer additionally agrees to provide MobileTel Internet with 30 days written notice of cancellation to MobileTel Internet Offices at PO Box 1416, Larose, LA 70373.
Miscellaneous

(a) MobileTel Internet reserves the right to change this agreement at any time.   By using any and/or all of MobileTel Internet Services, the customer agrees that he or she has read and understands these terms and policies and agrees to be bound by them.
(b) Customer(s) making use of the service certify that they are eighteen (18) years or older. If the Customer allows an individual under the age of eighteen year of age to access the Internet from the Customers MobileTel Internet account, The Customer takes full responsibility for the minor's access to any information that might be viewed as adult or unsuitable and agrees to hold harmless and indemnify MobileTel Internet for any claims or charges that may arise from said minor's use of the service.
(c)
Customer(s) recognizes that the Internet contains information that may be deemed obscene, offensive, and adult in content. The Customer accesses this information at their own risk, and understands that MobileTel Internet has no way to prevent access to this type of material, that is located on other servers, operated by other providers.
(d)
Customer(s) agrees to take responsibility for any and all information accessed, retrieved and /or storage of any and all information available to Customer from his / her MobileTel Internet Account. Customer indemnifies MobileTel Internet against any and all claims or charges relating to the information the Customer can or does access while using MobileTel Internet Account(s).
(e)
Personal Home Page server space may not be used for any commercial or organizational purposes. If the Customer wishes to advertise product(s) or service(s), Server space must be rented. Violation of this policy will result in the customer being charged for the advertising. Commercial and Organizational purposes are defined as being any type of advertising for profit. Non-profit organizations such as public schools, churches, non-profit organizations, etc. are not included in this definition.
(f)
Customer shall not intentionally allow unauthorized access connections to MobileTel Internet, unauthorized reselling of MobileTel Internet services, or other solicitation of MobileTel Internet users to become subscribers of other on-line information services or phone service providers competitive with SJI Communications, nor shall Customer in any way duplicate any MobileTel Internet materials, advertising, brochures, or like information which is proprietary to MobileTel Internet.
(g) MobileTel Internet provides a dial-up connection with unlimited normal usage. This Does Not Mean Unlimited Connection to MobileTel Internet. Customer agrees not to provide any public information service over this connection, not use any automated method to avoid inactivity disconnection, and to keep the connection active only while actively using the service.
(h)
Should any action be required by MobileTel Internet for any violation of these terms of service, The Customer will be held liable for all cost associated with such action.

Home Page Disclaimer
(a) Personal Home Page server space may not be used for any commercial or organizational purposes. If the Customer wishes to advertise product(s) or service(s), Server space must be leased. Violation of this policy will result in the customer being charged for the advertising. Commercial and Organizational purposes are defined as being any type of advertising for profit. Non-profit organizations such as public schools, churches, non-profit organizations, etc. are not included in this definition.
(b) While MobileTel Internet maintains a back-up schedule, it is the subscribers responsibility to back-up all personal homepages.
(c) Commercial and Organizational Pages are listed in alphabetical order by Company / Organization Name. Personal Pages are listed alphabetically by their users chosen title or users name. MobileTel Internet in no way endorses the views or content of the pages contained in these indexes.

Thank you for visiting our MobileTel Internet website. Your privacy is important to us. To better protect your privacy, we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used at this site.
The Information We Collect 
At this site, you can order products, enter contests, vote in polls or otherwise express an opinion, subscribe to one of our services or participate in one of our online forums. Special Note for Parents
We do not ever intend to collect personal information from children under 13. MobileTel Internet is concerned about the safety and privacy of children who use the Internet. Pursuant to the Children’s Online Privacy Protection Act of 1998, we will never knowingly collect personally identifiable information from anyone under the age of 13. If we become aware that a child under 13 has attempted to provide us with personally identifiable information, we will use our best efforts to remove such information from our files.
